BIDDING METHOD: This property will be offered in 2 tracts with each seperate side being offered as a tract.
Tract 1 Eastern tract consists of 141 acres. Your bid amount will be multiplied by 141 to determine your final bid amount.
Tract 2 Western tract consists of 131 acres. Your bid amount will be multiplied by 131 to determine your final bid amount.
Tract 3 Both tracts will be combined and will consist of 272 acres. Your bid amount will be multiplied by 272 to determine the final sales price.
Tract 1 will be offered and when the bidding has been competed the bid will be held. Tract 2 will then be offered and when the bidding has been completed the bid will be held. Both tracts will then be offered as a combination bid together. If the combination bid results in a higher net to the seller both tracts will be sold together as a combination.
INCOME AND PAYMENTS: Seller will retain all cash rent payments for 2009.
EARNEST DEPOSIT: 10% will be due and non-refundable from the buyer upon becoming the successful bidder at this auction event. The remainder will be due upon closing August 31, 2009 or before.
PURCHASE AGREEMENT: The successful buyer(s) will enter into a purchase agreement with the sellers the day of the auction event.
AGENCY: Whitetail Trophy Properties is a real estate brokerage licensed in Iowa and represents the seller. Gabe Adair is a licensed real estate salesperson in Iowa. Jason Smith will conduct the sale as the Auctioneer and is a licensed real estate salesperson in Iowa.
FINANCING: Your bidding is not contingent upon financing, all bids must be cash bids. All financing must be arranged prior to the auction event. All online bidders must provide proof of funds to bid online.
TAXES: All taxes will be prorated to the date of closing.
MINERAL RIGHTS: All mineral rights will transfer to the buyer.
POSSESSION TRACT 1: Full possession of Tract 1 will be given at closing.
POSSESSION TRACT 2: The buyer will have all hunting rights on this tract at closing but will be subject to tenants rights on the crop ground on this tract. Full possession of the crop ground will be given on March 1, 2010.
EASEMENTS: Subject to all easements, covenants, and restrictions in place.
